Bu form, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ("TKHK") ve Mesafeli Sözleşmeler Yönetmeliği kapsamında, Kibu Premium aboneliği satın alımınızdan önce sizi cayma hakkınız hakkında bilgilendirmek üzere hazırlanmıştır.

2. Satın aldığınız hizmet
Hizmet: Kibu Premium Aboneliği
Hizmet türü: Dijital içerik / Hizmet (mobil uygulama abonelik hizmeti)
Süre: Aylık (1 ay) veya Yıllık (12 ay)
Ücret: Uygulama içindeki satın alma ekranında gösterilen güncel fiyat (KDV dahil).
Yedi (7) günlük ücretsiz deneme süresi sunulmaktadır. Deneme dönemi sonunda otomatik olarak ücretli aboneliğe geçilir.
3. Ödeme aracı
Ödeme Google LLC tarafından işletilen Google Play Store üzerinden alınmaktadır. Ödeme bilgileriniz Google'ın güvenliği altındadır ve tarafımıza iletilmez.
4. Cayma hakkınız
TKHK m.48 ve Mesafeli Sözleşmeler Yönetmeliği m.15 kapsamında, ödeme tarihinden itibaren ON DÖRT (14) GÜN içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin sözleşmeden cayma hakkına sahipsiniz.
5. Cayma hakkının kullanılması
Cayma hakkını kullanmak için:
a) Cayma süresi içinde, açık ve anlaşılır bir bildirimle bize ulaşmanız gerekir:
- E-posta: support@mykibuapp.com (konu: "Cayma Hakkı")
- Yazılı: Fevzi Çakmak mah. Zambak sk no 5-7 Bahçelievler İstanbul Türkiye
b) Cayma bildirimi şunları içermelidir:
- Adınız ve soyadınız
- Hesabınızla ilişkili e-posta adresi
- Satın alma tarihi
- Abonelik türü
- Açık cayma beyanınız
c) İade işlemi:
- Cayma bildirimi alındıktan sonra 14 gün içinde ödediğiniz tutar ödeme yöntemine iade edilir.
- Google Play Store üzerinden ödeme yaptıysanız iade Google Play politikalarına göre işler.
- Ek bir bedel veya ceza talep edilmez.
6. Cayma hakkının istisnaları — Önemli
TKHK m.48/4 ve Mesafeli Sözleşmeler Yönetmeliği m.15/1(ğ) hükümleri uyarınca:
"Tüketicinin onayı ile ifasına başlanan ve cayma hakkı süresi bitmeden ifası tamamlanan hizmetlere ilişkin sözleşmelerde" cayma hakkı kullanılamaz.
Bu çerçevede:
- Premium aboneliğinize hemen erişim sağlamayı tercih edebilirsiniz.
- Bu durumda cayma hakkınızdan açıkça feragat etmeniz gerekir.
- Feragat etmezseniz, 14 gün boyunca Premium özellikler aktif edilmez ve sadece deneme süresi devam eder.
7. Abonelik iptali (cayma hakkından farklı)
Cayma hakkı süresi (14 gün) dolduktan sonra:
- Aboneliği istediğiniz zaman iptal edebilirsiniz.
- İptal bir sonraki yenileme tarihinde geçerli olur.
- Mevcut dönem sonuna kadar Premium özelliklerden yararlanmaya devam edersiniz.
- Kullanılmayan süre için iade Google Play politikalarına tabidir.
- İptal yöntemi: Telefonunuzda Google Play Store > Abonelikler > Kibu > İptal Et.
8. Uyuşmazlık çözümü
İade veya cayma hakkı ile ilgili uyuşmazlıklarda:
- Önce bizimle iletişime geçin: support@mykibuapp.com
- Tüketici Hakem Heyeti'ne başvurabilirsiniz (uyuşmazlık tutarı sınırı içinde).
- Tüketici Mahkemeleri'ne başvurabilirsiniz.
Tüketici Hakem Heyeti başvuru sınırları her yıl güncellenmektedir.
9. Cayma hakkından feragat beyanı
Premium aboneliğinize hemen erişim sağlamak için satın alma ekranındaki feragat kutucuğunu işaretlemeniz gerekir:
"Premium hizmete derhal erişmek istiyorum. 14 günlük cayma hakkımdan açıkça FERAGAT ediyorum. Hizmetin başlatılmasından sonra cayma hakkımı kullanamayacağımı biliyorum ve kabul ediyorum."
Bu kutucuğu işaretlemeden Premium hizmet başlatılamaz. İşaretlemek istemiyorsanız 14 gün boyunca yalnızca ücretsiz deneme süresi devam eder ve sonrasında abonelik aktive edilir.

Right of Withdrawal Information Form

This form has been prepared to inform you about your right of withdrawal under the Turkish Consumer Protection Law No. 6502 ("TKHK") and the Distance Sales Regulation, before purchasing the Kibu Premium subscription.

2. Service you purchased
Service: Kibu Premium Subscription
Service type: Digital content / Service (mobile application subscription service)
Duration: Monthly (1 month) or Yearly (12 months)
Price: Current price shown on the in-app purchase screen (VAT included).
A seven (7) day free trial period is offered. Automatic transition to paid subscription occurs at the end of the trial period.
3. Payment intermediary
Payment is received through Google Play Store operated by Google LLC. Your payment information is under Google's security and is not transmitted to us.
4. Your right of withdrawal
Under TKHK Article 48 and Distance Sales Regulation Article 15, you have the right to withdraw from the contract without showing any reason and without paying any penalty within FOURTEEN (14) DAYS from the payment date.
5. Exercising the right of withdrawal
To exercise the right of withdrawal:
a) You must contact us with a clear and understandable notification within the withdrawal period:
- Email: support@mykibuapp.com (subject: "Right of Withdrawal")
- Written: Fevzi Çakmak mah. Zambak sk no 5-7 Bahçelievler İstanbul Türkiye
b) Withdrawal notification must include:
- Your name and surname
- Email address associated with your account
- Purchase date
- Subscription type
- Your explicit withdrawal statement
c) Refund process:
- Within 14 days after receiving the withdrawal notice, the amount you paid is refunded to the payment method.
- If you paid via Google Play Store, the refund is processed according to Google Play policies.
- No additional fee or penalty is requested.
6. Exceptions to right of withdrawal — Important
Pursuant to TKHK Article 48/4 and Distance Sales Regulation Article 15/1(ğ):
"In contracts for services performed with the consumer's approval and completed before the right of withdrawal period expires," the right of withdrawal cannot be exercised.
In this context:
- You may prefer to gain immediate access to your Premium subscription.
- In this case, you must explicitly waive your right of withdrawal.
- If you do not waive, Premium features will not be activated for 14 days and only the trial period continues.
7. Subscription cancellation (different from right of withdrawal)
After the withdrawal period (14 days) expires:
- You can CANCEL the subscription at any time.
- Cancellation takes effect at the next renewal date.
- You continue to enjoy Premium features until the end of the current period.
- Refunds for unused period are subject to Google Play policies.
- Cancellation method: On your phone, Google Play Store > Subscriptions > Kibu > Cancel.
8. Dispute resolution
In disputes related to refund or right of withdrawal:
- First contact us: support@mykibuapp.com
- Apply to the Consumer Arbitration Committee (within dispute amount limit).
- Apply to Consumer Courts.
9. Waiver of right of withdrawal
To gain immediate access to your Premium subscription, you must check the waiver box on the purchase screen:
"I want to access the Premium service immediately. I explicitly WAIVE my 14-day right of withdrawal. I know and accept that I cannot exercise my right of withdrawal after the service is started."
Without checking this box, Premium service cannot be started. If you do not want to check, only the free trial period continues for 14 days and then the subscription is activated.
